The Western Middle Ages witnessed the emergence of a wide array of economic theories of public life and the common good that emphasized the worthiness (indeed priority) of ensuring a satisfactory arrangement of economic goods primarily for the sake of meeting the physical, temporal needs of individuals from all classes and orders. The chapter surveys a plethora of texts, dating from the middle of the twelfth century up to the end of the fifteenth, that considered pragmatic issues related to how (...) the material self-interest of human beings coincided with the augmentation of public wealth within a community, and especially how governmental policies promoted or hampered the goal of personal economic improvement. Despite the diversity of and occasional discordance among these writings, all of them fundamentally agree on two interrelated points: (1) the pursuit of material self-interest, rather than conflicting with or detracting from the common good, actually supports and enhances it; (2) the responsibility of government to promote the public welfare requires paying careful attention to the protection and promotion of private advantage. This article describes the Vaccine/Injury Project Corpus, a collection of legal decisions awarding or denying compensation for health injuries allegedly due to vaccinations, together with models of the logical structure of the reasoning of the factfinders in those cases. This unique corpus provides useful data for formal and informal logic theory, for natural-language research in linguistics, and for artificial intelligence research. More importantly, the article discusses lessons learned from developing protocols for manually extracting the logical structure and generating the logic (...) models. It identifies sub-tasks in the extraction process, discusses challenges to automation, and provides insights into possible solutions for automation. In particular, the framework and strategies developed here, together with the corpus data, should allow “top–down” and contextual approaches to automation, which can supplement “bottom-up” linguistic approaches. In this article I propose to study the principal points of constitutional interest contained in it. I have based my text on that of Professor Wilcken and M. Kougeas; and I follow Professor Wilcken and Mr. Tarn in identifying the new document with the constitution which Demetrius Poliorcetes imposed upon his pan-Hellenic League in 303–2 B.C.

John of Salisbury (c. 1115-1180) was the foremost political theorist of his age. He was trained in scholastic theology and philosophy at Paris, and his writings are invaluable for summarizing many of the metaphysical speculations of his time. The Policraticus is his main work, and is regarded as the first complete work of political theory to be written in the Latin Middle Ages. Cary Nederman's new edition and translation, currently the only version available in English, is primarily aimed at (...) undergraduate students of the history of political thought and medieval history. Adam SeagraveArguing for the proper placement of John Locke’s natural rights theory within intellectual history is a particularly high-stakes enterprise for historians of political thought and political theorists alike. This is due in large part to the fact that, as Brian Tierney notes in his recent study, it is “widely agreed that Locke’s work was (...) an important influence in the formation of modern liberal ideas, including ideas concerning rights.”1 Our understanding of Locke thus contributes to our reflective self-understanding as “modern liberals” (of one stripe or another) to an extent perhaps unequaled by any other thinker so far removed from our own time.As a result of the rare promise of studying Locke’s natural rights theory, there has been no shortage of scholarly attempts to determine its place in intellectual history on the basis of Locke’s own writings and their relation both to preceding and subsequent traditions and modes of thought. Although John Dunn had argued in his influential study that Locke’s political thought was too thoroughly steeped in theology to remain relevant in the contemporary context, this thesis has since been persuasively challenged (albeit in very different ways) by Simmons, Zuckert and Waldron, among others.2 Each of these scholars has contributed to an emerging agreement [End Page 305] that the thread of Locke’s natural rights theory may indeed be carried all the way up to current political and moral debates in some form or another. The precise length of this thread as it extends in the other historical direction has, however, remained a point of heated controversy. The scholarly literature on this issue may be broadly described in terms of a spectrum determined by two opposing emphases in understanding the relation of Locke’s natural rights theory to its medieval predecessors: a continuity emphasis and a discontinuity emphasis.On the discontinuity end of the spectrum stand those such as Michel Villey, Leo Strauss, C. B. Macpherson and, more recently, Michael Zuckert who argue for the existence of some sort of “Copernican moment” separating medieval natural rights theories from their modern counterparts.3 Whether this moment is identified with William of Ockham in the fourteenth century or Hobbes in the seventeenth century, these scholars tend to emphasize the distinctively “modern” character of Lockean natural rights theory and its significant departures from medieval modes of thought. According to many of the advocates of discontinuity, Lockean natural rights are not only “modern” in their political applications but also in their more profound meaning as foundations for morality, and particularly in their newly conceived relation to the concept of natural law.4The continuity end of the spectrum is, perhaps, more variegated, including scholars such as Tuck, Tierney, Tully, Oakley, Nederman, Coleman, and Swanson, among others.5 Despite their many important differences, [End Page 306] these scholars each focus upon the similarities between various elements or strains of medieval thought and modern natural rights theories rather than the differences between them. Building explicitly upon the work of Tuck, Tierney and Tully, Janet Coleman finds “some extraordinarily Lockean moments” in the medieval thinkers John of Paris and Godefroid of Fontaines, and argues that Locke ought to be understood as contributing to this medieval tradition of thought rather than departing from it.6 Scott Swanson, in turn, builds upon Coleman’s scholarship in carefully connecting medieval understandings of the rights of subsistence and the principle of extreme necessity to Locke’s natural rights theory. Phillip Cary argues that Augustine invented or created the concept of self as an inner space--as space into which one can enter and in which one can find God. This concept of inwardness, says Cary, has worked its way deeply into the intellectual heritage of the West and many Western individuals have experienced themselves as inner selves. After surveying the idea of inwardness in Augustine's predecessors, Cary offers a re-examination of Augustine's own writings, making the controversial point (...) that in his early writings Augustine appears to hold that the human soul is quite literally divine. Cary goes on to contend that the crucial Book 7 of the Confessions is not a historical report of Augustine's "conversion" experience, but rather an explanation of his intellectual development over time. Or leur pensée respective semble échapper à toutes les formes de catégorisation : ni pur " réalisme ", ni bellicisme, ni pensée de la " raison d'Etat ", (...) d'une part, ni idéalisme, "pacifisme ", ou pensée de la guerre juste, d'autre part, l'oeuvre de Hobbes et celle de Clausewitz occupent une place à part parmi ceux qui, semblablement à eux, ont pris la guerre pour objet de leur réflexion. More specifically, it identifies and critically examines three competing approaches to the idea of technological neutrality apparent in copyright jurisprudence. Ultimately, it is argued that true technological neutrality requires not simply the seamless expansion of legal rights into new technological contexts, but the careful, contextual recalibration of rights and interests in light (...) of shifting values and changing circumstances. As a normative principle, technological neutrality in copyright law thus demands a nuanced and relational understanding of the rights at play, and the social values that they seek to foster as technologies evolve. In other words, what would it mean to think criticism as a mode of taking (and making) time? What if one of the most crucial things we do when we read and write—but also, and still more importantly, when we look at or participate in the world—is to wait? This essay aims to give space, and time, to the question of critical attention, even as it will become clear that aiming is really the last thing anyone can be expected to do while they wait.What, then, could it mean to be critically attentive? That is to say, how might it be possible to give an account of those processes and states of suspension and expectation that lie within the moment or the sequence of critical attention? This question may seem less obvious—although there’s nothing wrong with the obvious—if we recall the resonance that attention has, in French or Italian for example, with certain words for waiting, with attente or attesa; if we take seriously how attending to something or someone may also be to wait for them. Critical attention, in this way, would put on hold—for a while if not necessarily forever—the evaluative and policing functions that so frequently attend what comes to be called critical; and it would do so precisely because it would take seriously what it means, and what it feels like, to attend.For Martin Seel, this is a specifically aesthetic question: “It is,” he says, near the beginning of his Aesthetics of Appearing, “a basic characteristic of all aesthetic relations that in them we take time for the moment” [20]. To take time for the moment, as Seel puts it, is also, I’d argue, to give time; to inscribe a kind of waiting at the heart of that moment, to respond, capaciously, to the objects or persons who are convoked there. This encounter—or what I’m tempted to call this convocation—is bound up, for Seel, with the complex presence of the encountered object: “Aesthetic perception,” he writes, “wants to take something in this light, in this movement, in this tone, in this roughness and coldness, in this weather and taste” [34]. This sequence—and notice how Seel returns to that deictic pronominal adjective “this” again and again—shows at least two things: the extent to which aesthetic perception’s mode of “taking” is no mere appropriation, given the drawn out, the literally distracted, effect of the object on the perceiver; and how this deictic disarray, caught up in “this” and “this” and “this” and “this,” is fed and fueled by a kind of wanting. Aesthetic perception, in other words, wants to take; but it ends up being taken. And when it is a matter of wanting—indeed, when it is a matter of being literally for the taking—the question and the encounter become more than just aesthetic. “Attention,” Simone Weil says, “consists of suspending our thought, leaving it detached, empty, [End Page 43] and ready to be penetrated by the object.”1 To wait for the world, for Weil, is to prepare to be entered by that (or perhaps another) world.
